Introduction and Acceptance

Welcome to Screenixx ("Screenixx," "we," "us," or "our"). By accessing or using our website, applications, or streaming services (collectively, the "Services"), you agree to be bound by these Terms of Use (the "Terms") and our associated policies. If you do not agree to these Terms, you should not use the Services. We may update these Terms from time to time; the “Last Updated” date at the end of this document will indicate the latest revision. Continued use of the Services after any modification constitutes acceptance of the revised Terms.

These Terms are an agreement between you and Screenixx. They describe your rights and responsibilities when using our Services, set expectations regarding behavior, and limit our liability. Additional policies (e.g., Privacy Policy, DMCA Policy, Accessibility Statement) are incorporated by reference and should be read together with these Terms.

Eligibility and Account Registration

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or purchase a subscription. Individuals between 13–17 years of age may use certain aspects of our Services with permission from a parent or guardian, who must agree to these Terms on their behalf. Children under 13 are not permitted to use the Services.

When you register an account, you agree to provide accurate and complete information and to keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately if you suspect any unauthorized access or breach of security. We reserve the right to suspend or terminate accounts that violate these Terms or are suspected of fraudulent activity.

Changes to the Services

We are continually evolving our platform. We may add, modify or remove features, content, or service offerings at any time without notice. We will not be liable if any part of the Services is unavailable, modified, or discontinued. We may also impose limits on certain features or restrict your access to parts or all of the Services without liability or notice.

Permitted Use

Screenixx grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial entertainment. You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Circumvent, disable or otherwise interfere with security-related features of the Services, digital rights management (DRM) systems or access controls.
• Copy, download, reproduce, broadcast, transmit, sell, license, or otherwise exploit any content obtained through the Services (except as expressly permitted by us).
• Use the Services to post or transmit any content that is unlawful, defamatory, abusive, harassing, hateful, threatening, violent, pornographic, obscene, or otherwise objectionable; that promotes discrimination or hatred; or that infringes any third-party rights.
• Reveal another user’s personal information, advocate violence, engage in illegal activity or solicit others to engage in unlawful acts.
• Send spam, chain letters, junk mail or unsolicited promotional messages.
• Use the Services in any manner that could disable, overburden, damage or interfere with the operation of the Services or any other user’s experience.

Failure to comply with these guidelines may result in suspension or termination of your account.

User Content

You may have opportunities to submit reviews, comments, messages, ratings, playlists, or other content ("User Content"). You retain ownership of your User Content, but by submitting it you grant Screenixx a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, sublicensable license to use, display, reproduce, modify, adapt, publish, translate, distribute and create derivative works from your User Content in any media now known or hereafter devised. This license allows us to feature your reviews or playlists, promote films and series, moderate submissions, and provide translations.

You represent and warrant that you own or control all rights in and to the User Content and have the authority to grant this license. You agree that your User Content will comply with these Terms and will not include anything that is defamatory, illegal, obscene or that infringes another’s intellectual property or privacy rights. We have the right (but not the obligation) to monitor, edit or remove User Content at our discretion and may suspend or terminate your account if you post prohibited content. We do not endorse any User Content and are not responsible or liable for it.

Intellectual Property

All content on the Services—including but not limited to films, video clips, audio tracks, text, graphics, logos, icons, images, software and other materials—is owned or licensed by Screenixx or our content partners and is protected by copyright, trademark, and other laws. Except for the limited license granted above, you acquire no ownership or intellectual property rights in the Services or any content. Any use of our trademarks, logos or branding without our prior written consent is strictly prohibited. We may take legal action to protect our intellectual property.

Third-Party Links and Services

Our Services may contain links to third-party websites, applications or services that are not owned or controlled by Screenixx. These links are provided for your convenience only. We do not endorse or assume responsibility for any third-party services, their content, or their privacy practices. When you leave our Services, your activities are governed by the terms and policies of those third parties; we encourage you to review them carefully. Screenixx will not be liable for any loss or damage arising from your use of third-party websites.

Subscriptions, Pricing and Payment Terms

Screenixx offers various subscription plans with recurring fees. By purchasing a subscription, you authorize us to charge your chosen payment method at the beginning of each billing cycle (monthly, quarterly or annually). We will disclose all compulsory charges and fees upfront—no hidden or “drip” pricing—and will not misrepresent our pricing or include fake reviews. Our subscription terms are designed to be transparent and fair, reflecting emerging consumer protection laws.

• Free Trial: If offered, the free trial period will be stated clearly, along with the date on which you will be billed if you do not cancel before the trial ends. We will send reminders when your trial is ending.
• Auto‑Renewal: Unless you cancel, your subscription will automatically renew at the end of each billing cycle. You can cancel auto-renewal anytime through your account settings or by contacting us. We will provide clear instructions to cancel and will not impose unfair barriers to stopping automatic renewal.
• Payment Methods: We accept major credit cards, debit cards and other payment methods as available. You authorize us to charge your selected payment method for recurring subscription fees, taxes and other charges. If your payment fails, we may suspend or terminate your access until payment is received.
• Price Changes: We may change our subscription fees, but we will notify you in advance. If you do not agree to the new price, you may cancel your subscription.
• Refunds: Subscription fees are non-refundable except as required by law or as otherwise stated in our refund policy. Digital streaming services are consumed upon provision; therefore, partial refunds for unused time are generally not available. In limited circumstances (e.g., a technical error or a statutory right of withdrawal), we may provide a refund or credit at our discretion.

Suspension and Termination

We reserve the right to suspend or terminate your access to the Services, remove content and take other remedial actions if you violate these Terms, break the law, infringe upon intellectual property rights, or otherwise misuse the Services. Suspension or termination may occur without prior notice if your conduct presents risk or harm to Screenixx, our users or our partners.

You may cancel your account at any time by following the instructions in your account settings or contacting customer support. After cancellation, you will not be charged for subsequent billing cycles, but previous charges will not be refunded unless required by law or by our refund policy. Sections of these Terms that by their nature should survive termination (e.g., ownership, liability, indemnity and dispute resolution) will continue to apply.

Disclaimer of Warranties

You agree that your use of the Services is at your sole risk. The Services and all content are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Services will be uninterrupted, error-free, secure or free from viruses or other harmful components. To the fullest extent permitted by law, Screenixx disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title and non‑infringement.

Limitation of Liability

To the maximum extent allowed by law, Screenixx and its affiliates, directors, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, data loss, personal injury, property damage or any other damages or losses arising out of or relating to your use of the Services. Our total liability for direct damages under these Terms will not exceed the amount you paid to Screenixx for the relevant subscription period, or one hundred U.S. dollars (USD $100) if no payments were made.

Some jurisdictions do not allow limitations of liability or exclusion of certain damages; in such jurisdictions, the liability of Screenixx will be limited to the fullest extent permitted by law.

Indemnification

You agree to indemnify, defend and hold harmless Screenixx and its affiliates, directors, officers, employees and agents from and against any claims, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or relating to: (i) your use or misuse of the Services; (ii) your User Content; (iii) your violation of these Terms; or (iv) your violation of any rights of another person or entity. We reserve the right to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with us in asserting any available defenses.

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions, and the federal laws of the United States. You and Screenixx agree to submit to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California, for any court proceedings that are permitted under these Terms.

Arbitration and Class Action Waiver

You and Screenixx agree that any dispute, claim or controversy arising out of or relating to the Services or these Terms will be resolved by binding arbitration on an individual basis rather than in court. Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. You waive any right to participate in a class-action lawsuit or class‑wide arbitration. Notwithstanding the foregoing, either party may bring an individual claim in small claims court or seek injunctive relief to stop unauthorized use or abuse of the Services or intellectual property rights.

International Users

Screenixx is based in the United States and is subject to U.S. laws. We may not be available in all countries, and some or all features may not be legal in your jurisdiction. You are responsible for compliance with local laws if you choose to access the Services from outside the United States. If you are a resident of the European Union, United Kingdom, or other region with specific regulatory frameworks, additional rights may apply as outlined in our Privacy Policy.

Miscellaneous

• Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force.
• Assignment: You may not assign or transfer these Terms or any rights granted under them without our prior written consent. We may assign these Terms or any rights without restriction.
• Entire Agreement: These Terms constitute the entire agreement between you and Screenixx regarding the use of the Services and supersede any prior agreements or understandings (oral or written) relating to the subject matter.
• No Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
